1. Acceptance
By using or registering on POS SAAS (the "Platform"), you agree to these Terms. If acting on behalf of a business, you confirm your legal authority to bind that entity. If you disagree with any provision, discontinue use immediately.
2. Service Description
POS SAAS is an integrated cloud platform providing a POS system covering sales, inventory, ZATCA-compliant e-invoicing, reporting, and payment-gateway integration in Saudi Arabia.
3. Trial Period (Complete Liability Exclusion)
The Platform may grant a free trial period to new users. Disclaimer: During this period the service is provided "AS IS" without any warranty. The Platform bears no legal or financial liability for any data loss or system downtime occurring during the trial period, as no fees have been paid for the service.
4. Subscriptions & Billing
The service is offered on monthly or annual plans. Advertised prices include 15% VAT per applicable regulations. Subscriptions auto-renew unless cancelled by the user at least 24 hours before the renewal date.
5. E-Invoicing & ZATCA Obligations
The Platform provides the technical tools required to connect with ZATCA Phase 2. The user is fully responsible for the accuracy of business data, tax numbers, and activity type. Retention Responsibility: The user acknowledges that the Platform is a processing and integration intermediary, and that retaining tax records and invoices for ten (10) years is the sole responsibility of the business (customer) per ZATCA regulations — particularly after ending the relationship with the Platform.
6. Service Suspension & Data Deletion on Non-Renewal
If the subscription expires and is not renewed: • Access to the service is suspended immediately. • The Platform grants the customer a grace period of only (30) days to export and download their data and invoices by emailing [email protected]. • After the 30 days elapse, the Platform is entitled to permanently delete all business data from its servers. • The user acknowledges the forfeiture of any legal claim against the Platform arising from this deletion, and bears sole responsibility for the loss of tax records before governmental authorities.
7. User Accounts & Security
You are responsible for the confidentiality of your login credentials. Sharing the business account with unauthorised parties is strictly prohibited. Report any suspected breach immediately to [email protected].
8. Acceptable Use
The Platform may not be used for any activity violating Saudi law, nor to attempt to breach platform infrastructure, nor to resell the service without prior written consent from POS SAAS.
9. Intellectual Property
All IP rights in the software, interfaces, and trademarks are owned by POS SAAS. Transaction and product data entered by the user remain the user's property; the Platform has the right to process them technically solely to deliver the service.
10. User Data & Privacy
We comply with the Privacy Policy at gigapos.cc/privacy and with the Saudi Personal Data Protection Law (PDPL).
11. Limitation of Liability (Core Clause)
To the maximum extent permitted by law, the aggregate liability of POS SAAS for any claims or direct damages arising from the use of the service is limited to the subscription fees actually paid by the user for the last month preceding the claim. The Platform is not liable for any lost profits, indirect damages, or tax penalties resulting from the customer's misuse of the system.
12. Downtime & Maintenance
We strive to maintain service availability above 99.9%. The service may be interrupted for scheduled maintenance, for which users will be notified in advance. Outages beyond our control (e.g. global Internet or data-centre outages) do not entitle compensation.
13. Voluntary Termination & Data Deletion (User-Initiated)
The user may cancel the subscription at any time from the dashboard. • Final Deletion: Upon the user's request to delete the account or business, all data and invoices will be permanently and immediately removed from the Platform's servers. • Backup Download: The Platform undertakes to provide a "Data Export" option to the user prior to deletion. The user's confirmation of deletion constitutes an acknowledgement that they have saved a copy of their tax records and releases the Platform from any future obligation to retain them.
14. Governing Law & Disputes
These Terms are governed by and interpreted in accordance with the laws of Saudi Arabia. Any dispute will first be resolved amicably within 30 days; failing which, the Saudi courts in the city of Buraidah shall have jurisdiction. For legal inquiries: [email protected]
